Dear Councillor Feltmate:


As part of the terms of settlement of my appeal of zoning for "325 =
Didsbury Road" (the Loblaw/Taggart     development) members of the Carp =
River Coalition have been provided with copies of the draft Conditions =
for this Subdivision.  We were told that you had not yet given your =
concurrence.

We are meeting with counsel Alan Cohen and project manager Jeff Parkes =
this Friday to discuss the draft Conditions as we were given them.  We =
thought we'd let you know what our main concerns are.  They centre on =
Conditions 44-50 (Stormwater Management), where:

1) Registration and commencement of work should be tied explicitly to=20
        a) approval of the three Environmental Assessments for Kanata =
West, and=20
        b) an agreement on cost-sharing of the Restoration project and a =
commitment to its implementation;=20

2) the Stormwater Conditions should also cover any interim measures or =
facilities.

3) There should be clear commitment that no cut and fill will take place =
before the EAs are approved & any appeal periods have expired or appeals =
have been resolved.  In that regard we were heartened by the quotation, =
in reply to our concern, by Mattamy's project manager, Mr. Rob Boyd, =
from a February 22, 2006 letter from the MVCA to the City: "MVC will not =
be in a position to issue a permit [for cut & fill] under Ontario =
Regulation 159/90 until such time as all public appeal periods under =
either the Planning Act or the Environmental Assessment Act have =
expired. Any appeals that may be registered will also have to be =
resolved."

4)  In Condition 46 (in the para. on Erosion & Sediment Control) "and in =
accordance with the recommendations of the Carp River =
Watershed/Subwatershed Study"  should be added.

5) In Condition #48, "or that the Stormwater Management measures have =
been constructed to the satisfaction of the City"  should be deleted.

Members of the Carp River Coalition are now at their third set of =
Conditions they have examined (after Broughton and Mattamy).  In  =
Conditions # 55 and 47 respectively of the Mattamy Subdivision we see =
something close to what we are looking for under 1).
