  I have been asked to respond to an email sent to Councillor Maria McRae regarding an article in the Ottawa Citizen about Kanata West.  The following will provide a more accurate description of the situation then was given in the article as well as address the issues you raised in your message.  
   
  Firstly, the City’s Department of Planning and Growth Management at the outset, stipulated the requirement for the three Class Environmental Assessment studies being carried out for the Kanata West development area (KWDA).  Although a tremendous amount of work was completed as part of the Kanata West Concept Plan, the supporting infrastructure servicing studies required further technical analysis and input to support the plan of subdivision approval process.  The City, as a co-proponent on the Class EAs, has ensured throughout the process that City and public interests have been identified and addressed.  Provincial agencies have also been consulted to ensure their technical issues are being satisfactorily addressed.  City staff have worked diligently on this project to ensure that the Class EAs meet City and agency technical standards and process requirements.  
  Although the approval authority has changed from the Ontario Municipal Board under an integrated process to the Minister of Environment, the steps in the process remain the same in terms of the technical and consultative requirements of the studies.  As you are aware, originally the Class EAs were being integrated with the plan of subdivision approval process such that the development and project approvals were subject to the Planning Act.  The City saw many benefits to this process as it provided a “one window” integrated approach to the various development applications and three Class EAs such that infrastructure was not fragmented and planned in isolation of one another.  It also provided the public with a single point of contact at the City for inquiries.  
  The City consulted the Ministry of Environment on process and technical issues throughout the study process.  The integration provision has not been widely applied in the Province and as such, it took time for all parties to come to a full understanding of the situation.  Based on these discussions, the MOE EA Approvals Branch advised the City and Kanata West Owners Group that the planning approvals and Class Environmental Assessments should precede independently.  The MOE felt that the scale of the projects was too large to attach to two plans of subdivisions.  The MOE recognized the great deal of work done to date on these projects.  They suggested that the work be "repackaged" with a different end point being the Minister of Environment not the OMB.  The City and KWOG are now proceeding with three parallel but inter-related projects - a Master Transportation Plan, Master Servicing Plan and the Carp River, Poole Creek and Feedmill Creek Restoration Class EA project.
  This information on process and approval change was recently shared with the public at the March 7th open house.  We wanted to ensure that the public was informed about process change and also how comments expressed at the last open house had been addressed.  All public inquiries have been responded to on an on-going basis and integrated into the applicable Class EA.
  No matter what the process, the Class EAs had to satisfy city and provincial agency staff in terms of level of technical information and analysis.  Additional time was needed to bring closure to city and agencies comments such that the City is now in a position to move forward for City Council approval.
   
  The builders have never been given the go ahead to develop the lands in Kanata West.  The development of lands within the KWDA is contingent on the approval of the Class Environmental Assessment studies and separate planning approvals.  Permission from the City was granted to construct the five model homes located on Maple Grove, unserviced, at the risk of the developer.  The development application process is now independent of the Class EA process.  However, draft conditions of subdivision stipulate that the development can only proceed if it conforms to and implements the Class EAs, once approved.  Capital (or construction) projects identified in the three Class EAs cannot advance until completion of the Class EA process.
   
  In terms of floodplain encroachments, the Carp River corridor width that is proposed in the Class EA document varies from the existing 75 metre to intervals of 100 m, 150m, 200m, and 250 metres.  The Carp River flood plain, in many locations, is greater than 100 m and downstream (north) of Highway 417 the existing flood plain width is narrower than 100 m.  The floodplain encroachments is relatively minor as it represents approximately 28 hectares or 15% total loss of existing flood plain storage considering the reach between Richardson Side Road and Hazeldean Road. 
   
  Section 3.1.6 of the Provincial Policy Statement (2005) states:
   
  Further to policy 3.1.5, and except as prohibited in policies 3.1.2 and 3.1.4, development and site alteration may be permitted in those portions of hazardous lands and hazardous sites where the effects and risk to public safety are minor so as to be managed or mitigated in accordance with provincial standards, as determined by the demonstration and achievement of the following:
   
  a)      development and site alterations is carried out in accordance with flood proofing standards, protection works standards and access standards;
  b)      vehicles and people have a way of safely entering and exiting the area during times of flooding, erosion and other emergencies;
  c)      new hazards are not created and existing hazards are not aggravated; and
  d)      no adverse environmental impacts will result.
   
  The analysis completed by CH2M Hill as part of the Class Environmental Assessment process has demonstrated that these criteria have been addressed to the satisfaction of the Mississippi Valley Conservation Authority, the agency of record for this approval.
   
  A report is being brought forward to a joint meeting of Planning & Environment Committee and Transportation Committee on May 3rd recommending approvals of the preferred projects identified in the three Class EA reports.  Once City Council has approved the projects, City staff and the KWOG will finalize the documents and file the Class EA reports for a 30-day public review.  The public will have an opportunity to review the documents and submit comments within the 30-day review period.  However, if you still have outstanding concerns that have not been addressed, you may write the Ministry of Environment and request a Part II Order. 
   
  City staff extended an invitation to meet with you last October to discuss this project, however, no response to this meeting invitation was received.  We encourage your attendance at the upcoming April 20th meeting with members of the Carp River coalition to discuss the technical details of the Class EAs.  We can spend time discussing issues that you and the group have raised in a meaningful way with the three Ward Councillors, City and MVC staff, the consultant team and representatives from the KWOG.
